A lease is a written agreement between a tenant and the owner/manager of a property.

It outlines the terms and conditions under which the tenant is allowed use of the property, the expected payment and date payment is due, the term of the lease, and outlines which utilities (if any) the tenant will be responsible for paying.

Whether you are looking to sign a lease for the first time or have rented before, it is important for you to know your rights and responsibilities as a tenant. This tenant brochure from the Manitoba government is a good place to start.

What is a guarantor?
A guarantor is anyone who is willing to cover rent (and other) costs if the tenant is unable to. Landlords may request a guarantor if they’re unsure if a tenant will be able to pay their rent. 

What is a security deposit?
Most owners/property managers request a security deposit to ensure any unpaid rent or damage to the property is covered when the tenant leaves. This is usually in the amount of one full month’s rent. If you have a pet, there may also be a deposit to cover any damages the pet may incur.

Clean, damage-free apartments are usually reimbursed all or part of their security deposit. Before signing the lease, ask if a security deposit is needed, and if so, what it is for and when it is due. Landlords must inform tenants of required deposits before the tenant signs the lease. They must also provide a receipt noting the amount of the deposit, the date the landlord received the deposit, and the address and unit number of the rental unit.

What is a condition report?
Condition reports are written documents noting the condition of the apartment, including any issues or damages, when the tenant moves in or moves out. The landlord and tenant should inspect the premises together and make note of any damages, such as burns, torn flooring, etc. Both parties should sign and date the condition report at the end of the inspection, with each party receiving a copy.

Can my landlord increase my rent?
Landlords can increase the rent (in most cases) every 12 months. They must provide written notice three months in advance of the increase, with a maximum increase of 3%. For regulations surrounding rent increases, see the Residential Tenancies Branch website.

What if I have to leave before the lease term ends?
Ask your landlord for their policy with regards to early termination of the lease contract. Usually, a sublet or assignment arrangement is allowable. 

What if a conflict arises between my landlord and me?
It is always best to try and work out disagreements directly with your landlord; however, in circumstances where this is not possible, a government regulator can step in and moderate. If you experience an issue with your landlord that you’re unable to resolve on your own, contact the Residential Tenancies Branch for their mediation services.

How can I avoid online rental scams?
Ask to see the unit before you agree to rent it. Contact the landlord or property manager directly to arrange to sign the lease and pay the deposit. If you are subletting, pay the landlord/property manager directly—do not pay the tenant from whom you are subletting. Only the landlord/property has the ability to accept your application and take payment. Reference this fact sheet for more information on rental scams.
